Abstract

Since 2018, Article 238 of the Criminal Code of the Russian Federation has been actively used in the Russian Federation in cases of unfavorable outcomes in the provision of medical care. This has led to dissatisfaction among medical workers, especially in "risky" specialties (obstetrics, anesthesiologist-intensive care specialist), exacerbating the personnel crisis. In 2024, amendments to the Criminal Code of the Russian Federation (Federal Law No. 514-FZ) were adopted, excluding medical care from Article 238. Medical workers, including anesthesiologist-intensive care specialist, were given the opportunity to review their sentences and return to professional activities. However, the success of the defense depends on knowledge of legal nuances and analysis of judicial practice, especially in the context of reclassification of cases and the application of statutes of limitations. Awareness of the medical community remains critically important for minimizing legal risks.
